DemandDraft Terms of Service

Last updated: September 29, 2026

Please read these points first.

  • DemandDraft is not a law firm. No lawyer reviews your letter, and using DemandDraft does not make any lawyer your lawyer.
  • You choose which laws go in your letter, you confirm the facts, and the letter is sent in your name.
  • Most disputes with us must be resolved by individual arbitration, not a class action or jury trial. You can opt out within 30 days. See Section 23.

1. Who we are and what these Terms cover

These Terms of Service ("Terms") are an agreement between you and Demand Draft, LLC ("DemandDraft," "we," "us"). They apply to our websites, including demanddraft.ai and blog.demanddraft.ai, our letter service, our certified-mail service and our free tools (together, the "Service").

You accept these Terms by checking the box that says you agree, and then creating an account or completing a purchase. If you do not agree, do not use the Service. We keep a record of which version of these Terms you accepted and when.

Our Privacy Policy explains how we handle your information. It is part of these Terms.

2. What DemandDraft is — and what it is not

DemandDraft is a self-help software service. It helps you prepare and send a letter, in your own name, about a dispute you have with a business.

  • We are not a law firm. We do not give legal advice, legal opinions or legal representation.
  • No one reviews your letter for you. No lawyer reviews your answers, your choices or your letter. No one at DemandDraft checks or approves them before your letter is created or sent. Our staff may see your information when they run the Service, fix a problem or answer your questions. That is not a review of your letter and is not legal advice.
  • No attorney-client relationship. Using the Service does not create an attorney-client relationship between you and DemandDraft, or between you and any lawyer.
  • No privilege. What you type or upload is not protected by attorney-client privilege or attorney work-product protection. It could be requested in a lawsuit or by a subpoena.
  • Not a substitute for a lawyer. The Service is not a substitute for the advice of an attorney. If you want advice about your situation, your rights or your deadlines, talk to a lawyer licensed in your state.

3. How the Service works

  • You describe what happened in your own words and answer our questions.
  • We show you laws from your state that relate to consumer transactions and your type of dispute. Every customer in your state sees the same list. Our software may highlight laws that it predicts relate to what you described. Those highlights are automated guesses. They may be incomplete or wrong, and they are not legal advice.
  • You choose which laws, if any, to include. Nothing is selected for you. You can include laws we did not highlight and leave out laws we did.
  • We prepare a draft letter. It quotes the laws you chose and restates the facts you gave us. It does not say that the business broke the law and does not reach any legal conclusion. Our software may reword your description, so check that every statement in the letter is accurate.
  • You review, edit and approve the letter. You are responsible for what it says. You decide whether to download it, mail it yourself, or have us mail it for you (Section 7).
  • We keep a record of the list you were shown, the laws you chose and the letter you approved.

4. AI-generated content

We use artificial intelligence, including AI models provided by other companies, to highlight laws, organize your facts and draft your letter. AI makes mistakes. In particular, AI output may:

  • leave out a law that applies to you, or highlight one that does not;
  • contain an incorrect citation, or a quotation that does not match the current official text of a law;
  • reflect a law that has been changed or repealed;
  • misstate or leave out a deadline, including a deadline to file a claim;
  • add, change or leave out facts, including details you never gave us;
  • use the law of the wrong state.

Before you send any letter, read every word. Check the facts against your own records, and check each law against its official text. You, not DemandDraft, decide whether the letter is accurate and whether to send it.

Deadlines. The Service does not track or calculate legal deadlines. Sending a letter does not stop, pause or extend any deadline for bringing a claim.

5. Your promises to us

By using the Service, you promise that:

  • the information you give us is true, accurate and complete to the best of your knowledge;
  • you chose the laws included in your letter;
  • you will read your full letter before you download or send it, and you will not send a letter containing a statement you know or believe is false;
  • the letter is your own communication, sent in your name and on your behalf, and you are its author and sender;
  • you have the right to share everything you upload or tell us, including information about other people;
  • you will use the Service only for lawful purposes and as these Terms allow.

6. What you may not do

You may not use the Service to:

  • make statements you know are false or misleading, or that defame or harass anyone;
  • threaten anyone with criminal charges, public exposure, or reports to regulators, review sites or the media in order to get money or anything else — your letter may ask for a remedy and may say that you plan to take the matter to court;
  • pursue a matter in which you are accused of a crime;
  • pursue a matter in which a lawyer already represents you, unless your lawyer agrees;
  • send a letter on someone else's behalf without their permission;
  • prepare letters for other people as a business or for payment;
  • copy, scrape, reverse-engineer or resell the Service or its content;
  • interfere with the Service's security or operation.

We may refuse, stop or cancel any use that we reasonably believe breaks this Section.

7. Certified mail service

If you choose our mailing service:

  • We act only as your messenger. You authorize us to act as your agent for one limited purpose: printing the letter you approved and sending it by U.S. certified mail to the address you give us. We use a third-party mail provider, currently Lob.
  • We send exactly what you approved. We do not review, edit or approve the content of your letter before mailing it.
  • You confirm before we mail. Before anything is mailed, you will be asked to confirm that you have read the letter, that the facts in it are true, and that you are sending it as your own communication.
  • We may decline to mail. We may decline to mail any letter for any lawful reason, including if we believe it breaks Section 6. If we decline before the letter goes to our mail provider, we will refund you in full.
  • Mailing is final. Once your letter goes to our mail provider, it cannot be recalled or changed.
  • We cannot guarantee delivery. We do not guarantee that the U.S. Postal Service will deliver your letter, when it will arrive, or that anyone will sign for it. We are not responsible for delays or failures by the Postal Service or our mail provider. We will pass on the tracking information we receive.
  • Addresses are your responsibility. You must give us the recipient's correct name and address.

8. Free tools and legal information

We offer free tools, including Repair Law Lookup, and publish general information such as our state-by-state guides to auto repair law.

Repair Law Lookup puts two facts side by side: what a law in your state says, and what you told us. For example, it may show that your state's law requires a repair shop to give a written estimate before starting work, and that you said the shop did not give you one. It does not say whether the business broke the law, whether you have a claim, or what would happen if you pursued one.

This is general information only. Results from a free tool are automated and based only on your answers and the laws our software matched to them. They are not a legal opinion, do not assess your situation the way a lawyer would, and do not predict what will happen. Our software may miss a law that applies to you or show one that does not. Laws change, and our guides may be out of date or incomplete. Sections 2, 4, 19 and 20 apply to the free tools as well.

9. No guarantee of results

We do not promise that the business you write to will respond, pay you, fix the problem, settle, or do anything else. We do not promise that any law in your letter applies to your situation, or that you would win if you went to court. Many disputes are not resolved by a letter.

10. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract. The Service is for disputes in the United States. You must give us accurate account information and keep your login secure. You are responsible for what happens under your account.

11. Where the Service is available

The Service is available to customers in the states listed at demanddraft.ai/availability. We may change that list, and we may limit or change features in a particular state to comply with its law. Terms for specific states are in Appendix A. If a state-specific term conflicts with the rest of these Terms, the state-specific term controls for customers in that state.

12. Prices, payment and refunds

We show you the price before you pay. It includes certified mailing if you choose to have us mail your letter. The price at checkout is the total you pay, apart from any taxes. Payments are handled by a third-party payment processor, and we do not store your full card number.

Refunds.

  • If you have not downloaded, printed or mailed your letter, you may ask for a full refund within 30 days of purchase.
  • If we decline to mail your letter, or cannot mail it, we will refund you in full.
  • If you are charged more than once for the same order, we will refund the extra charges.
  • If the Service fails because of our error, we will fix the problem or refund you.
  • Otherwise, once you have downloaded your letter, fees are not refundable, except where the law requires a refund.

To ask for a refund, email support@demanddraft.ai. We send approved refunds to your original payment method within 10 business days.

13. Unfinished orders

If you pay but do not finish your letter within 120 days, we may close the order. We will email you before we do. If you have not downloaded or mailed your letter, you may still ask for a refund under Section 12.

14. Electronic communications and signatures

You agree that we may give you notices, receipts and other communications electronically, by email or through the Service, and that they count as "in writing." You can withdraw this consent by emailing support@demanddraft.ai, but we may then be unable to provide the Service. You can ask for a paper copy of these Terms at the same address.

If your letter includes your electronic signature, you authorize us to apply it only in the form and place you approve. You can withdraw that authorization at any time before you approve the final letter.

Emails about your account and orders, such as receipts and mailing updates, are part of the Service. We may also send you marketing emails. You can unsubscribe from those at any time using the link in each one.

15. Your content

"Your Content" means everything you give us: your description, your answers, your uploads (such as photos and invoices) and your letter. You own Your Content.

You give us a limited permission to store, process and use Your Content only to provide the Service to you and to comply with the law. That includes sharing it with the companies that help us run the Service, such as our AI, hosting, email, payment and mail providers, under contracts that limit their use of it. We do not use Your Content to train AI models, and our AI providers are not permitted to do so. We may create statistics that do not identify you or anyone else, and use them to run and improve the Service.

We may keep or disclose Your Content if the law requires it, or if we believe in good faith that it is necessary to respond to legal process, protect someone's safety or enforce these Terms.

We keep Your Content for the periods set out in our Privacy Policy, and you can ask us to delete it. Please keep your own copy of your letter; the Service is not a storage service.

Reviews. If you choose to give us a review, you allow us to publish it and use it in our marketing, along with your first name, city, state and age range. You give us a free, permanent, worldwide license to use the review for those purposes. If we offer you anything in exchange for a review, we will say so, and it will not depend on the review being positive.

If you send us feedback or suggestions, we may use them without any obligation to you.

16. Our intellectual property

The Service, including our software, design, text, templates, guides and trademarks, belongs to DemandDraft or the companies that license it to us. We give you a personal, non-transferable, revocable license to use the Service as these Terms allow. You may keep, print, copy and send the letters you create for your own dispute. You may not otherwise copy, sell, license, modify or distribute the Service or its content.

Trademarks. All product and service names, slogans and logos on the Service are trademarks of Demand Draft, LLC. You may not copy, imitate or use them, in whole or in part, without our written permission. The look and feel of the DemandDraft brand is also protected as a service mark, trademark and trade dress. Other company and product names on the Service may be trademarks of their owners. These Terms do not give you any right to use our trademarks or anyone else's.

17. Copyright complaints

If you believe something on the Service infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to our designated agent: Demand Draft, LLC, Attn: DMCA Agent, P.O. Box 5086, Ventura, CA 93005, or support@demanddraft.ai. We may close the accounts of repeat infringers.

18. Privacy

Our Privacy Policy explains what information we collect, how we use and share it, how long we keep it, and your rights, including how to access or delete your information.

19. Disclaimer of warranties

TO THE EXTENT THE LAW ALLOWS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE OR ANYTHING IT PRODUCES WILL BE ACCURATE, COMPLETE, CURRENT OR ERROR-FREE. Some states do not allow these disclaimers, so some or all of them may not apply to you.

20. Limitation of liability

TO THE EXTENT THE LAW ALLOWS:

  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA, ARISING OUT OF THE SERVICE.
  • OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE TOTAL FEES YOU HAVE PAID US.

These limits do not apply to liability for our fraud, willful misconduct or gross negligence; for death or personal injury caused by our negligence; or to any liability that the law does not allow us to limit, including under consumer protection laws that cannot be waived.

21. Indemnification

To the extent the law allows, you agree to cover DemandDraft's losses and reasonable legal costs from any claim brought by someone else, including the business you write to, to the extent the claim arises from:

  • facts or information you gave us that were false, or that you had no right to share;
  • a statement in a letter you approved that you knew, or should have known, was false; or
  • your breach of these Terms.

This does not apply to the extent a claim arises from our own negligence or misconduct.

22. Refusal, suspension and termination

We may suspend or end your access to the Service if we reasonably believe you have broken these Terms, used the Service in a way that could harm others or expose us to legal liability, or if the law requires it. We will try to tell you first. You may stop using the Service at any time.

We may also decline any order or refuse service to anyone, for any lawful reason. If we decline an order after you have paid, we will refund you in full.

Suspension or termination does not take away any right the law gives you, such as the right to access or delete your personal information. Sections 2, 4, 5, 9, 15 and 19 through 26 continue to apply after your use ends.

23. Resolving disputes

Please read this Section carefully. It affects your rights.

(a) Talk to us first. Before starting an arbitration or a small-claims case, you and we each agree to send the other a written notice describing the dispute and what is being asked for, and then to try in good faith to resolve it for 30 days. Send your notice to support@demanddraft.ai and to Demand Draft, LLC, P.O. Box 5086, Ventura, CA 93005. Any deadline for bringing the claim is paused during those 30 days.

(b) Arbitration. If we cannot resolve it, any dispute between you and DemandDraft relating to the Service or these Terms will be resolved by binding arbitration between you and us individually. The arbitration will be run by JAMS under its rules and its minimum standards for consumer arbitrations. It will take place in the county where you live or by video, unless we both agree otherwise. We will pay all arbitration fees and costs, except any filing fee JAMS's consumer rules require you to pay. The arbitrator may award you any individual relief a court could award.

(c) What does not have to be arbitrated. Either of us may bring an individual claim in small-claims court in the county where you live, if the claim qualifies. Either of us may go to court over infringement or misuse of intellectual property. Nothing here stops you from reporting a concern to a government agency.

(d) No class actions. You and we may each bring claims only individually, not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine different people's claims or award relief to a group. This does not stop you from seeking public injunctive relief where the law allows it. Any request for public injunctive relief will be decided by a court after the individual claims are arbitrated, and that part of the case will be paused until then.

(e) Many similar claims. If 25 or more similar arbitration demands against DemandDraft are filed by the same lawyers or organizations, they will be handled under the JAMS Mass Arbitration Procedures. Each claim will still be decided on its own facts, and the outcome of one person's claim will not bind anyone else.

(f) Your right to opt out. You can opt out of this arbitration agreement by emailing support@demanddraft.ai from your account email address, with the subject line "Arbitration Opt-Out," within 30 days after you first accept these Terms. Opting out does not affect the rest of these Terms. If you opt out, disputes will go to court under Section 24.

(g) Changes to this Section. If we change this Section, the change will not apply to a dispute you have already told us about, and you may reject the change by notifying us within 30 days.

(h) If part of this Section is invalid. If the class-action waiver in (d) cannot be enforced for a particular claim, that claim will go to court, not arbitration. If any other part of this Section cannot be enforced, the rest still applies.

(i) Jury trial waiver. FOR DISPUTES COVERED BY THIS SECTION, YOU AND WE EACH GIVE UP THE RIGHT TO A JURY TRIAL.

24. Governing law and courts

These Terms are governed by California law and by federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. If you live in another state, you keep the protection of any consumer protection law of your state that cannot be waived by contract.

Any dispute that is not arbitrated may be brought in the state or federal courts of Ventura County, California, or of the county where you live, at your choice.

25. Changes to these Terms

We may update these Terms. We will post the new version with a new "last updated" date. If we make a material change, we will tell you by email or through the Service before it takes effect, and we will ask you to accept the new Terms before your next purchase. Changes do not apply to orders already placed or to disputes you have already told us about.

26. General

  • Entire agreement. These Terms, the Privacy Policy and anything they refer to are the whole agreement between you and us about the Service.
  • If part is invalid. If any part of these Terms cannot be enforced, the rest still applies.
  • Changes to the Service. We may change, suspend or discontinue any part of the Service at any time. If we discontinue something you have paid for and not yet received, we will refund you for it.
  • Transfer. You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of our business.
  • No waiver. If we do not enforce a term right away, we can still enforce it later.
  • Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control.
  • Contact. Demand Draft, LLC, P.O. Box 5086, Ventura, CA 93005; (805) 895-5037; support@demanddraft.ai.
